1. Acceptance of Terms
By creating an account, sending or receiving messages, or otherwise using an Application, you confirm that you have read, understood and agreed to these Terms and to our Privacy Policy, which is incorporated herein by reference.
2. Description of the Service
Our Applications provide messaging and automation features that allow businesses to communicate with their customers through the WhatsApp Business Platform and related Meta services. Features may include automated replies, message routing to human agents, notifications and integrations with third-party systems. We may add, change or remove features at any time.
3. Eligibility
You must be at least 18 years old and have the legal capacity to enter into these Terms. If you use an Application on behalf of a business, you represent that you are authorized to bind that business to these Terms.
4. User Responsibilities
- Provide accurate information and keep your credentials secure;
- Use the Application in compliance with all applicable laws and with Meta's policies;
- Obtain valid opt-in/consent from recipients before sending them messages, as required by the WhatsApp Business Platform;
- Be solely responsible for the content of the messages you send through the Application.
5. Acceptable Use
You agree not to use any Application to:
- Send spam, unsolicited or deceptive messages;
- Distribute unlawful, harmful, infringing, hateful or fraudulent content;
- Violate the rights of third parties or any applicable law or regulation;
- Attempt to gain unauthorized access to, disrupt or interfere with the Application, its servers or networks;
- Reverse engineer, resell or misuse the Application or its underlying APIs.
Violation of this section may result in immediate suspension or termination of access.
6. Third-Party Services
Our Applications rely on services provided by Meta and may rely on other third-party providers. We are not responsible for the availability, accuracy or policies of those third-party services. Your use of them is governed by their respective terms.
7. Intellectual Property
All rights, title and interest in and to the Applications, including software, design and trademarks, belong to us or our licensors. These Terms do not grant you any ownership rights. You may not copy, modify or distribute any part of an Application without our prior written consent.
8. Disclaimer of Warranties
The Applications are provided "as is" and "as available", without warranties of any kind, whether express or implied, including fitness for a particular purpose, merchantability or non-infringement. We do not warrant that the Applications will be uninterrupted, error-free or secure.
9. Limitation of Liability
To the maximum extent permitted by law, we shall not be liable for any indirect, incidental, special, consequential or punitive damages, or for any loss of data, profits or revenue, arising out of or related to your use of (or inability to use) the Applications.
10. Indemnification
You agree to indemnify and hold us harmless from any claims, damages, losses or expenses (including reasonable legal fees) arising from your use of an Application, your content, or your violation of these Terms or of any applicable law.
11. Suspension and Termination
We may suspend or terminate your access to any Application at any time, with or without notice, if you violate these Terms or if required to protect the service, other users or comply with the law. You may stop using the Applications at any time.
12. Changes to These Terms
We may update these Terms from time to time. The most recent version will always be available at this address, with the "Last updated" date shown at the top. Continued use of an Application after changes take effect constitutes acceptance of the revised Terms.
13. Governing Law
These Terms are governed by the laws of the Federative Republic of Brazil, without regard to conflict-of-law principles. Any dispute shall be submitted to the competent courts of Brazil, unless otherwise required by applicable consumer-protection law.
